O per\u00edodo de experi\u00eancia original pode ser prorrogado por um per\u00edodo adicional, de at\u00e9 3 meses. O trabalhador deve receber um aviso por escrito sobre a renova\u00e7\u00e3o antes do t\u00e9rmino do per\u00edodo inicial.<\/p>\n<p>Um trabalhador pode renunciar fornecendo um aviso por escrito \u00e0 organiza\u00e7\u00e3o. Uma empresa tamb\u00e9m pode rescindir o contrato de um trabalhador fornecendo um aviso por escrito de demiss\u00e3o. Conforme estipulado no contrato de trabalho, a dura\u00e7\u00e3o do aviso necess\u00e1rio \u00e9 a mesma em ambos os casos.<\/p>\n<p>A Se\u00e7\u00e3o 12 (2) da Lei do Emprego de 1955 estabelece que o per\u00edodo m\u00ednimo de aviso \u00e9:<\/p>\n<ul>\n<li>4+ semanas se o tempo de servi\u00e7o for inferior a 2 anos<\/li>\n<li>6+ semanas se o tempo de servi\u00e7o for de 2 anos ou mais, mas inferior a 5 anos<\/li>\n<li>8+ semanas se o tempo de servi\u00e7o for de 5 anos ou mais<\/li>\n<\/ul>\n\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-311a7e0 elementor-widget elementor-widget-text-editor\" data-id=\"311a7e0\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Tanto a empresa quanto o empregado podem rescindir o contrato de trabalho sem o devido aviso. Essa a\u00e7\u00e3o geralmente exigiria que a parte que rescinde o contrato indenize a outra parte com uma compensa\u00e7\u00e3o em substitui\u00e7\u00e3o ao aviso pr\u00e9vio.<\/p>\n<p><strong>Os empregados n\u00e3o t\u00eam direito a indeniza\u00e7\u00e3o compensat\u00f3ria nas seguintes situa\u00e7\u00f5es:<\/strong><\/p>\n<ul>\n<li>Se o empregado tiver trabalhado por um per\u00edodo <strong>inferior a 12 meses<\/strong> (na data da rescis\u00e3o)<\/li>\n<li>Se <strong>renovarem seu contrato de trabalho com termos e condi\u00e7\u00f5es melhores<\/strong> do que no acordo
