Se reconocen los contratos verbales, pero las mejores pr\u00e1cticas siempre recomiendan acuerdos escritos para evitar malentendidos posteriores y garantizar la claridad.<\/p><p>El per\u00edodo de prueba est\u00e1ndar en <b>Ecuador es de 3 meses y el per\u00edodo de preaviso previo a la terminaci\u00f3n es de 30 d\u00edas.<\/b><\/p><p>La legislaci\u00f3n laboral en Ecuador permite el despido repentino sin justificaci\u00f3n pero implica el pago de una indemnizaci\u00f3n.<\/p><p>En un contrato de duraci\u00f3n indefinida (el contrato de trabajo est\u00e1ndar), el empleado tiene derecho a recibir indemnizaciones por despido de la siguiente manera:<\/p><p>En caso de renuncia del empleado, el <b>empleado tiene derecho al pago del 25% de su \u00faltimo salario mensual<\/b> por cada a\u00f1o de servicio.<\/p><p>Si el despido fue por despido repentino y sin justa causa, el trabajador tiene derecho a un mes de salario por a\u00f1o de<b> servicio pero no menos de 3 salarios mensuales.<\/b><\/p><p>Sin embargo, el empleador no est\u00e1 obligado a pagar una indemnizaci\u00f3n por despidos por causa justificada, como <b>falta de puntualidad reiterada o abandono del trabajo.<\/b><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-404f2de elementor-widget elementor-widget-heading\" data-id=\"404f2de\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">Horas De Trabajo<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-72a4c3f2 elementor-widget elementor-widget-text-editor\" data-id=\"72a4c3f2\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>La jornada <b>laboral legal en el Ecuador<\/b> es la siguiente:<\/p><ul><li><b>40 horas por semana<\/b><\/li><li><b>5 d\u00edas\/semana<\/b><\/li><li><b>8 horas\/d\u00eda<\/b><\/li><\/ul><p>El s\u00e1bado y el domingo son d\u00edas de descanso obligatorio. Cuando no se pueda suspender la actividad laboral en domingo o s\u00e1bado, el empleador podr\u00e1 acordar con el trabajador otros 2 d\u00edas consecutivos de descanso. Los empleados a los que se les solicita trabajar en d\u00edas de descanso tambi\u00e9n tienen derecho a recibir el 200% del salario est\u00e1ndar para esos d\u00edas.<\/p><p>El m\u00e1ximo de horas extraordinarias es de 4 horas diarias y 12 horas semanales. Los empleados que trabajan horas extras tienen derecho a beneficios adicionales de la siguiente manera:<\/p><ul><li><b>150% del salario horario regular por horas extras realizadas durante el d\u00eda.<\/b><\/li><li><b>200% del salario horario regular por horas extras trabajadas entre la medianoche y las 6:00 am y por trabajos realizados los s\u00e1bados, domingos o d\u00edas de descanso.<\/b><\/li><\/ul><p>Sin embargo, un empleador est\u00e1 exento del pago de horas extras cuando las horas extras son necesarias para solucionar accidentes causados por el empleado y por empleados en puestos de confianza o directivos.<\/p><p>Una jornada laboral de 8 horas deber\u00e1 tener un descanso de hasta 2 horas despu\u00e9s de las primeras<b> 4 horas trabajadas.<\/b><\/p><p>El
